Hereinafter referred to as "Odyssée du Voyage"
Article 1.2. Purpose
These general terms and conditions define the rights and obligations of the parties in the context of the marketing by Odyssée du Voyage of tourist services provided directly by Odyssée du Voyage or by partner service providers, intended for individuals who qualify as consumers or non-professionals as defined by the French Consumer Code, or as travelers as defined by the French Tourism Code, and who have the legal capacity to enter into a contract (hereinafter referred to as "the Client(s)").
Article 1.3. Definitions
Client: a natural person who qualifies as a consumer or non-professional as defined by the French Consumer Code, or as a traveler as defined by the French Tourism Code, and who enters into a contract with Odyssée du Voyage under these general terms and conditions of sale.
Service: a travel service or package tour as defined in Article L. 211-1 of the French Tourism Code.
Online Contract: a contract concluded for the purchase of service(s) on a website.
Distance Contract: any contract concluded between a professional and a consumer, within the framework of an organized system of distance selling or service provision, without the simultaneous physical presence of the professional and the consumer, through the exclusive use of one or more means of distance communication up to and including the conclusion of the contract/quote, excluding the Odyssée du Voyage website.
Durable Medium: any instrument enabling the consumer or Odyssée du Voyage to store information addressed personally to them so that they can be referred to later for a period of time appropriate to the purposes for which the information is intended and which allows the identical reproduction of the stored information (Article L. 121-16 of the French Consumer Code).
Article 2 – Content and Scope These general terms and conditions of sale apply automatically to all services sold or offered for sale by Odyssée du Voyage. These terms and conditions apply to sales made through all distribution and marketing channels. Any order or purchase implies unreserved acceptance of these general terms and conditions of sale, which prevail over all other conditions, except those expressly accepted by Odyssée du Voyage and included in the signed booking contract/quote. The Client declares having read and accepted these general and specific terms and conditions of sale before making their booking and concluding the signed contract/quote.
Article 3 – Pre-contractual Information The Client acknowledges having received, prior to placing their order and/or concluding the signed contract/quote, in a legible and understandable manner, these general and specific terms and conditions of sale and all the information listed in Article L. 221-5 of the French Consumer Code and Article R. 211-4 of the French Tourism Code. The Client also acknowledges having received the form issued pursuant to the decree of March 1, 2018, "establishing the model information form for the sale of travel and stays."
Article 4 - Price
Article 4.1. Final Price and Additional Taxes The final price is quoted in euros, inclusive of all taxes (VAT), per person or as a package price for groups. It may be calculated based on the number of participants. The price includes the items listed in the signed quote/contract.
Article 4.2. Payment Terms The Client guarantees to Odyssée du Voyage that they have all necessary authorizations to use the payment method chosen when validating the contract/signing the quote. Odyssée du Voyage reserves the right to suspend all booking management and service provision in the event of a payment authorization refusal by officially accredited organizations or in the event of non-payment of any sum due under the contract. Payments made by the Client will only be considered final after Odyssée du Voyage has effectively received the sums due. The Client has several secure payment methods available. The optimal payment method is chosen from the following, depending on the type of service booked, as indicated in the specific terms and conditions of sale:
a. by credit or debit card (Visa, Mastercard, etc.),
b. by bank check, (for France only)
c. by bank transfer (transfer fees are the responsibility of the Client),
d. by holiday vouchers, (for France only)
e. in cash
Article 5 – Price Revision
Odyssée du Voyage undertakes to apply the rates in effect at the time of booking but reserves the right to unilaterally modify its prices under the conditions set forth in this article. In accordance with Article L. 211-12 of the French Tourism Code, the price may be adjusted upwards or downwards after booking confirmation to take into account changes in:
1° The price of passenger transport resulting from the cost of fuel or other energy sources;
2. The level of taxes or fees on travel services included in the signed contract/quote, imposed by a third party not directly involved in the execution of the contract, including tourist taxes, landing fees, and port and airport embarkation and disembarkation fees; or
3. Exchange rates related to the contract.
Any price increase applied pursuant to the preceding paragraph will be clearly and comprehensibly communicated to the Client, along with a justification and calculation, on a durable medium, no later than twenty days before the start of services. Conversely, the Client is entitled to a price reduction corresponding to any decrease in the costs mentioned in points 1, 2, and 3, which occurs after the conclusion of the signed contract/quote and before the start of the trip or stay. In the event of a price reduction, Odyssée du Voyage has the right to deduct its actual administrative expenses from the refund due to the Client. At the Client's request, Odyssée du Voyage will provide proof of these administrative expenses. If the surcharge exceeds 8% of the total price of the package or travel service, the Client may accept the proposed modification or request cancellation of the contract without penalty and receive a full refund of all payments already made.
Article 6 – Reservations
The booking conditions are described in the specific terms and conditions of sale. The deposit payment is specified in the quote provided to the Client before booking.
Article 7 – No Right of Withdrawal
Article L. 221-28 of the French Consumer Code stipulates that the right of withdrawal cannot be exercised for contracts for accommodation services, other than residential accommodation, transport services for goods, car rentals, catering, or leisure activities that must be provided on a specific date or during a specific period. Article L. 221-2 of the French Consumer Code also excludes this right for passenger transport and package holidays. Odyssée du Voyage asserts this absence of a right of withdrawal and indicates that for all services falling within the scope of Article L. 221-28 or L. 221-2 of the French Consumer Code, the Client will not have any right of withdrawal.
Article 8 – Contract Modification
Article 8.1. Modification by Odyssée du Voyage
Odyssée du Voyage may unilaterally modify the terms of the Contract after its conclusion and before the start of the travel service, without the Client being able to object, provided that the modification is minor and that the Client is informed as quickly as possible in a clear, understandable, and prominent manner on a durable medium. If Odyssée du Voyage is forced to unilaterally modify one of the main characteristics of the contract as defined in Article R. 211-4 of the French Tourism Code, if it cannot meet the specific requirements agreed upon with the Client, or if the price increase exceeds 8%, it will inform the Client as soon as possible, clearly, comprehensibly, and prominently, on a durable medium: of the proposed modifications and, if applicable, their impact on the price of the trip or stay; of the reasonable timeframe within which the Client must communicate their decision to Odyssée du Voyage; of the consequences of the traveler's failure to respond within the specified timeframe; and, if applicable, of the alternative service offered, as well as its price. When the modifications to the Contract or the substitute service result in a decrease in the quality of the trip or stay or its cost, the traveler is entitled to an appropriate price reduction. If the contract is terminated and the Client does not accept another service, Odyssée du Voyage will reimburse all payments made by or on behalf of the Client as soon as possible, and no later than fourteen days after the termination of the contract.
Article 8.2 Modification by the Client
Any shortened or unused stay due to the Client, or any stay that begins late due to the Client, will not be eligible for a refund. Odyssée du Voyage is only obligated to the Client for the services sold. Odyssée du Voyage shall not be held liable for: - any service purchased by the Client other than that invoiced by Odyssée du Voyage; - any modification of services initiated by the Client. Any modification must be expressly accepted in writing by Odyssée du Voyage. The modification may be subject to additional charges, which will be communicated to the Client before implementation.
Article 9 – Contract Termination
Article 9.1. Contract Termination by the Client
The Client may terminate the contract at any time before the start of the service. For this termination to be valid, the Client must inform Odyssée du Voyage by email or mail. In this case, Odyssée du Voyage will require the Client to pay a cancellation fee and may retain all or part of any deposits or balances already paid, according to the payment schedule for the service. The cancellation schedule is indicated in the specific terms and conditions of sale. This cancellation fee will not be due if the contract is terminated due to exceptional and unavoidable circumstances occurring at the destination or in its immediate vicinity and having significant consequences on the performance of the contract. In this case, Odyssée du Voyage will provide a full refund of payments made, without any additional compensation. The cancellation date is the date of receipt by Odyssée du Voyage of the Client's request, which does not need to be justified.
Article 9.2. Termination of the contract by Odyssée du Voyage
Odyssée du Voyage has the right to terminate the contract at any time before the start of the service. The Client will be entitled to additional compensation, corresponding to the amount the Client would have been entitled to had the contract been terminated by them, as stipulated in Article 9.1 of these general terms and conditions of sale. However, Odyssée du Voyage will not be liable for any additional compensation if the contract is terminated in the following two cases:
1) The number of people registered for the trip or stay is less than the minimum number indicated in the contract. In this case, Odyssée du Voyage will notify the Client of the contract termination by email or mail within the timeframe specified in the signed contract/quote, according to the following schedule: - twenty days before the start of the trip or stay for trips lasting more than six days; - seven days before the start of the trip or stay for trips lasting between two and six days; - forty-eight hours before the start of the trip or stay for trips lasting no more than two days;
2) Odyssée du Voyage is prevented from fulfilling the contract due to exceptional and unavoidable circumstances. In this case, Odyssée du Voyage will notify the traveler of the contract termination by email or other written means as soon as possible before the start of the trip or stay.
Article 10 – Transfer of the Contract
Article 10.1. Client's Right to Transfer the Contract The Client may transfer their contract to a transferee who meets the same requirements as the Client to benefit from the services, provided that the contract has not yet taken effect, and only for the land portion of the trip, as transportation tickets are nominative and non-exchangeable and non-refundable.
Article 10.2. Notice Period for Transferring the Contract The Client may only transfer their contract if they inform Odyssée du Voyage of their decision by any means that provides proof of receipt, no later than seven days before the start of the trip. This transfer is not subject to prior authorization from Odyssée du Voyage under any circumstances.
Article 10.3. Joint and Several Liability of the Transferor and the Transferee The transferring Client and the transferee are jointly and severally liable for payment of the outstanding balance and any additional costs that the transfer may incur.
Article 11 – Legal Guarantee of Conformity
The Client, whether a consumer or a non-professional, must notify Odyssée du Voyage of any defects and/or non-conformities as soon as possible after the services have been provided, in accordance with Article L. 211-16 II of the French Tourism Code. This notification, with supporting documentation, should preferably be made within 7 days of the completion of the services, so that Odyssée du Voyage can investigate the issue and assess the validity of the alleged defects effectively and in the interest of both parties. Any defects and/or flaws found will result in rectification, substitution, price reduction or refund within the as soon as possible, taking into account the significance of the non-conformity and the value of the travel services concerned. If Odyssée du Voyage offers a replacement service or a price reduction, the traveler may only refuse the alternative services offered if they are not comparable to what was stipulated in the contract or if the price reduction granted is inappropriate. Odyssée du Voyage's guarantee is limited to the reimbursement of services actually paid for by the consumer or non-professional Client, and Odyssée du Voyage shall not be held liable or in default for any delay or non-performance resulting from a force majeure event or exceptional or unavoidable circumstances. In accordance with Article R 211-6, 4° of the French Tourism Code, the Client may contact Odyssée du Voyage promptly using the contact details provided in Article 1.1. The "Designation of the Seller" in these general terms and conditions of sale is used to communicate effectively with the Seller, request assistance if the Customer is experiencing difficulties, or address any complaints regarding non-conformity observed during the execution of the trip or stay.
Article 12 – Protection of Personal Data
Article 12.1. Data Collected As part of its business selling Tourist Stays and Services, Odyssée du Voyage implements and operates personal data processing related to Customers and Beneficiaries. In this capacity, Odyssée du Voyage collects the following personal data: first name, last name, title, postal address, email address, telephone number, family composition, specific details noted in the contract, payment methods, and dates of birth.
Article 12.2. Purpose of the Contract: The collection of this personal data is essential for contract performance. Refusal to provide this data may result in difficulties in the performance of the service, for which Odyssée du Voyage cannot be held liable. This personal data is collected solely for the purpose of managing Odyssée du Voyage's customer base within the framework of the contract's conclusion and execution, based on the customer's consent. It is used only for the purposes to which the customer has consented.
More specifically, the purposes are as follows:
- Identification of individuals using and/or booking services
- Formalization of the contractual relationship
- Provision of services booked with Odyssée du Voyage
- Contract and booking management (including room allocation and travel arrangements)
- Communication with partners to facilitate the provision of services by the relevant partners
- Accounting, including customer account management and customer relationship monitoring
- Processing of customer management transactions
- Marketing communications, prospecting, and promotional activities.
Article 12.3. Authorized Persons with Access to Data
The following persons are authorized to access the data collected within Odyssée du Voyage: employees of Odyssée du Voyage and its partners involved in the services requested by the Client, and, where applicable, Odyssée du Voyage's subcontractors participating in the execution and/or administration of the services and who are involved in the processing of the data. It should be noted that in such cases, whether involving partners or subcontractors, this is done in compliance with applicable regulations.
Article 12.4. Data Retention
This personal data is retained for the legally required retention period related to the purpose of the processing and for a maximum of [5 years]. Personal data relating to the Client's bank card is retained only for the time necessary to complete the transaction. Personal data relating to a prospective customer who does not enter into a booking contract with Odyssée du Voyage is kept for a period of 3 years from the date of collection. Personal data necessary for sending the newsletter is kept for as long as the customer does not unsubscribe, when a newsletter is offered. Odyssée du Voyage implements organizational, technical, software, and physical measures for digital security to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment, and Odyssée du Voyage cannot guarantee the security of the transmission or storage of information on the Internet. Odyssée du Voyage has formalized the rights and obligations of customers and beneficiaries with regard to the processing of their personal data contained in a document accessible at the following address: address and upon request from Odyssée du Voyage.
Article 12.5. Rights of the Data Subject
In accordance with applicable regulations regarding personal data, each user has the right to access, modify, object to, and rectify, for legitimate reasons, the collection and processing of their personal data. It is possible to request that this data be rectified, completed, clarified, updated, or erased. These rights can be exercised by sending a signed letter to the data controller at [name and email address of the data controller], attaching a copy of your identity document to your request. Odyssée du Voyage has appointed a Data Protection Officer (DPO): Laetitia Deturck-Garnon. The Client may, at any time, lodge a complaint with the CNIL (French Data Protection Authority) according to the procedures indicated on its website (https://www.cnil.fr).
Article 12.6. Amendment of this clause
Odyssée du Voyage reserves the right to amend this clause relating to the protection of personal data at any time. If an amendment is made to this personal data protection clause, Odyssée du Voyage undertakes to publish the new version on its website and will also inform users of the amendment by email at least 15 days before the effective date.
Article 12.7. Opting out of telemarketing

Article 13 – Insurance
Our professional liability insurer covers us against the financial consequences of professional liability as defined in Articles L. 211-16 and L. 211-17 of the French Tourism Code. This coverage also includes damages caused to travelers, service providers, or third parties as a result of errors, omissions, or negligence committed during the offering, organization, and sale of our services, whether by us or by our employees and contractors. The Client agrees to maintain and keep up-to-date liability insurance to cover any damages they may cause. We offer optional insurance in partnership with ASSUREVER. All information regarding this optional insurance is provided with the quote, including the insurance product information document.
Article 14 – Minors
When minors, unaccompanied by a parent or other authorized person, travel under a travel services contract that includes accommodation, Odyssée du Voyage must provide information enabling direct contact with the minor or the person responsible for the minor at the minor's place of stay.
Article 15 – Odyssée du Voyage's Liability
Article 15.1 – Strict Liability Except for sales to professionals and services provided by Odyssée du Voyage, Odyssée du Voyage is strictly liable for the travel services contracted under these general terms and conditions of sale. However, Odyssée du Voyage may be relieved of all or part of its liability by proving that the damage is attributable either to the Client, to a third party unrelated to the provision of the travel services included in the contract, or to exceptional and unavoidable circumstances. Odyssée du Voyage and the retailer are responsible for the proper performance of all travel services included in the contract, in accordance with Article L. 211-16.
Article 15.2. Limitation of Liability: In accordance with Article L 211-17, IV of the French Tourism Code, the amount of any damages that Odyssée du Voyage may be ordered to pay the Client for any reason whatsoever shall be limited to three times the total price excluding taxes of the services, with the exception of personal injury and damage caused intentionally or by negligence.
Article 16 – Exceptional and Unavoidable Circumstances
Any event that creates a situation beyond the control of both Odyssée du Voyage and the Client, and whose consequences could not have been avoided even if all measures had been taken, thus preventing the performance of their obligations under normal conditions, shall be considered grounds for exemption from the parties' obligations and shall result in their suspension. The party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as their disappearance.
Article 17 – Assistance to the Traveler
Odyssée du Voyage is responsible for the proper performance of the services stipulated in the contract. In this context, if the Client encounters difficulties, Odyssée du Voyage will provide appropriate assistance as soon as possible, taking into account the specific circumstances. Odyssée du Voyage will be entitled to charge a reasonable price for this assistance if the difficulty is caused intentionally by the traveler or by their negligence. The price charged will not exceed the actual costs incurred by the organizer or retailer.
Article 18 – Accessibility
Despite our best efforts, some services are not accessible to people with reduced mobility. We encourage you to inquire if you have mobility difficulties.
Article 19 – Dispute Resolution
Article 19.1. Applicable Law
These general terms and conditions are governed by French law. This applies to both substantive and procedural rules.
Article 19.2. Mediation
The Customer may resort to conventional mediation, in particular with the Consumer Mediation Commission or with existing sector-specific mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute. The Customer may also contact the Tourism and Travel Mediator on the following website: https://www.mtv.travel/ or at MTV Médiation tourisme voyage, BP 80 303 75 823 Paris Cedex 17 if the response provided by Odyssée du Voyage to the Customer's complaint is deemed insufficient or remains unanswered after 60 days.
Article 19.3. Online Sales
If the service was purchased online by the Customer, they are hereby informed that, in accordance with Article 14.1 of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, they have the right to lodge a complaint and select a dispute resolution body on the following website: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=FR.
Article 19.4. Evidence
It is expressly agreed that the data contained in Odyssée du Voyage's information systems shall be considered conclusive evidence of orders, requests, and any other element relating to the use of the Website. This data may be validly produced, in particular in court, as evidence in the same way as any written document.
Article 20 – Linked Travel Arrangements
If, after choosing and paying for a travel service, you book additional travel services for your trip or holiday through Odyssée du Voyage, you will NOT be entitled to the rights applicable to packages under Directive (EU) 2015/2302 and Article L.211-2 of the French Tourism Code. However, if you book additional travel services during the same visit or contact with Odyssée du Voyage, the travel services will be considered part of a linked travel arrangement. In this case, Odyssée du Voyage has protection, as required by European Union law, to refund the sums you have paid for services that were not performed due to its insolvency. Odyssée du Voyage has taken out insolvency protection with UNAT, 8 rue César Franck, 75015 Paris, France. Travelers can contact this entity if they are refused travel services due to Odyssée du Voyage's insolvency. Note: this insolvency protection does not apply to contracts concluded with parties other than Odyssée du Voyage, which may be performed despite Odyssée du Voyage's insolvency.
Article 21 – Information [see for Special Terms and Conditions of Sale]
Administrative and Health Formalities
Regardless of the destination and countries visited, you must ensure that each traveler (including children and infants) is in possession of a biometric passport with an integrated chip and digital photo, valid for at least 6 months after the return date of the trip, as well as any other necessary documents (visa, ESTA authorization, family record book, exit permit, etc.) that meet the requirements for transiting through and/or entering the country(ies) of travel and/or transit. A national identity card alone is not accepted as proof of identity, even for trips within Europe with stopovers exclusively in European Union countries. Odyssée du Voyage provides this information for all French citizens. It is the responsibility of each traveler to verify that their documents, particularly administrative and health documents, required for the trip, are in accordance with the information provided by the organizer, it being understood that it is the responsibility of the person
The organizer, who concluded the travel quote/contract, is responsible for relaying information regarding formalities to each of the travelers registered for the trip. Odyssée du Voyage cannot, under any circumstances, be held liable for the consequences of each traveler's failure to comply with police, customs, or health regulations. A traveler who is unable to travel (particularly a flight) due to failure to present the required documents, as specified in the sales contract provided to them, will not be entitled to any refund. Foreign nationals are advised to consult their consular authorities. For formalities and information regarding the country(ies) of travel, the organizer recommends consulting the fact sheets for the countries visited during your trip, available on the website of the Ministry for Europe and Foreign Affairs (MEAE) www.diplomatie.gouv.fr, under the heading "Travel Advice/Country Advice." The organizer draws attention to the fact that information may change up to the departure date and advises travelers to consult them regularly. For certain destinations, the organizer may require you to sign the MEAE (Ministry of Foreign Affairs and International Development) information sheet for the country(ies) visited or transited, as part of their obligation to provide information. This request does not constitute a waiver of liability. https://www.diplomatie.gouv.fr/fr/conseils-aux-voyageurs/ Odyssée du Voyage provides the health information available at the time the contract is concluded. It is recommended that you regularly consult the information published by the relevant authorities regarding health risks in the country(ies) of your trip and follow the recommendations and health measures to combat these risks, available on the websites http://solidarites-sante.gouv.fr (French Ministry of Solidarity and Health) or www.who.int/fr (World Health Organization).
Passenger Information
For the organization of the Client's trip, certain countries and/or service providers (including customs authorities, airlines, and shipping companies) require the transmission of some of your personal data in order to complete forms and/or comply with instructions related to their booking and/or control systems. For this purpose, Odyssée du Voyage is obligated to provide these service providers with the following information for each traveler (including children and infants): last name, first name(s), gender, date of birth, nationality, and postal address as they appear on the passport you will use for your trip and to complete transit or entry authorizations (visa, ESTA, etc.), as well as an email address and telephone number.
IMPORTANT: The Client must provide the same information above (last name, first name(s), date of birth, and gender) exactly as it appears on all other forms required for the trip, particularly for flights with American airlines or for trips with a transit or destination in the USA. Failure to comply with this procedure may result in the Client being refused entry to the transit or destination territory.
COVID-19 Pandemic
Due to the COVID-19 health crisis, health protocols have been strengthened. Some destinations require a complete vaccination schedule and/or an additional PCR or antigen test. Wearing a mask is mandatory on trains and planes and may also be required during the various services booked. As information is evolving depending on the spread of the epidemic and may vary depending on the services, health measures will be reconfirmed a few weeks before departure. The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code. You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed into the French Tourism Code. Odyssée du voyage/Wild Nature Trips will be fully responsible for the proper execution of the package as a whole. Furthermore, as required by law, Odyssée du voyage has protection in place to refund your payments and, if transport is included in the package, to ensure your repatriation should it become insolvent.
Key rights under Directive (EU) 2015/2302 transposed into the French Tourism Code:
Travelers will receive all essential information about the package before concluding the package travel contract. The organizer and the retailer are responsible for the proper execution of all travel services included in the contract. Travelers will receive an emergency telephone number or contact details enabling them to reach the organizer or the retailer. Travelers may transfer their package to another person, subject to reasonable notice and possibly subject to certain conditions to pay additional fees. The package price can only be increased if specific costs rise (for example, fuel prices) and if this possibility is explicitly provided for in the contract, and in any case, it cannot be changed less than twenty days before the start of the package. If the price increase exceeds 8% of the package price, the traveler can cancel the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction if the corresponding costs decrease. Travelers can cancel the contract without paying cancellation fees and receive a full refund of payments made if any of the essential elements of the package, other than the price, undergoes a significant change. If, before the start of the package, the professional responsible for the package cancels it, travelers can obtain a refund and compensation, if applicable. Travelers may cancel the contract without paying a cancellation fee before the start of the package holiday in exceptional circumstances, such as serious security problems at the destination that are likely to affect the package.
